Plaintiff was injured when an 18-wheeler struck the construction machinery they were operating on the side of a highway. The investigating police officer determined Plaintiff failed to yield the right of way by operating the machinery in the highway lane of traffic, and that both parties failed to pay attention. Plaintiff sustained injury to their low back in an area where they had a prior surgery. Plaintiff underwent two surgeries to repair the damage at the level above the prior surgery. <\/p>
