{"id":22673,"date":"2018-05-23T12:00:04","date_gmt":"2018-05-23T17:00:04","guid":{"rendered":"https:\/\/www.terrybryant.com\/?p=22673"},"modified":"2024-01-05T10:59:14","modified_gmt":"2024-01-05T16:59:14","slug":"worker-misclassification-tx","status":"publish","type":"post","link":"https:\/\/www.terrybryant.com\/blogs\/worker-misclassification-tx","title":{"rendered":"Worker Misclassification in Texas"},"content":{"rendered":"<h1>Worker Misclassification Lawyers<\/h1>\n<h2>Employee Misclassifications in Texas Can Lead to Underpaid Wages<\/h2>\n<p>\t\t\t\tA study released in March 2018 reveals that immigrants are twice as likely as native-born workers to be employed in industries where violations of core labor standards are pervasive \u2013 as much as 17% of the United States labor force.\u00a0 According to the study, this is especially pronounced in Texas and has a negative impact on the state\u2019s labor force.<\/p><div id=\"glm-mobile-toc-box\" style=\"display: none;\"><\/div>\n<p>A study by The Migration Policy Institute\u00a0(MPI) \u2013 <a href=\"https:\/\/www.migrationpolicy.org\/research\/strategic-leverage-use-state-and-local-laws-enforce-labor-standards-immigrant\" target=\"_blank\" rel=\"noopener noreferrer\">Strategic Leverage: Use of State and Local Laws to Enforce Labor Standards in Immigrant-Dense Occupations<\/a> \u2013 analyzes systemic wage underpayment and misclassification of workers in industries that employ a large number of immigrants.\u00a0 Hotspots where an overly large number of violations occur are found in construction, service businesses (which include cleaning and food service), and transportation. Misclassifying employees as independent contractors allows employers to avoid paying payroll taxes, overtime, and workers&#8217; compensation. It also enables employers to evade federal law that requires new hires to document that they can legally work in the U.S.<\/p>\n<p>The MPI study, which also includes research into payroll fraud associated with employment violations, pays homage to a previous investigation by <a href=\"https:\/\/www.mcclatchy.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">McClatchy Newspapers<\/a>\u00a0in 2014.\u00a0 That investigation revealed that misclassification of construction workers in Texas resulted in a $1.2 billion loss in state tax revenue.<\/p>\n<h2>Protections for Low-income Workers<\/h2>\n<p>As a result, the Texas Workforce Commission (TWC), along with workers\u2019 rights groups in Texas, is revamping efforts to increase protections for low-income laborers and pushing the Legislature to crack down on employers which uniformly and intentionally misclassify their employees.<\/p>\n<p>According to the TWC, the number of misclassified Texas workers between 2010 and 2012 was around 35,000. During those two years, 4,300 construction employees and 4,100 in the health care and social assistance fields were incorrectly reported as independent contractors. Those 8,400 workers alone account for lost revenue of about $2.4 million to the state\u2019s unemployment insurance fund, according to a <a href=\"http:\/\/www.lbb.state.tx.us\/Documents\/Publications\/GEER\/Government_Effectiveness_and_Efficiency_Report_2015.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">report<\/a> by the Texas Legislative Budget Board.<\/p>\n<div class=\"call-out\">\n\u201cWorker misclassification prevents employees that would otherwise qualify for workers&#8217; compensation or other benefits from receiving those benefits,\u201d according to Maxie Gallardo, a policy analyst with the Workers Defense Project, an Austin-based advocacy group. \u201cIt strips them of their rights as employees.\u201d\n<\/div>\n<p>Since 2008, 27 states and the District of Columbia have passed bills addressing worker misclassification, forcing employers to pay accurate payroll taxes and legitimately deduct them from employee paychecks. \u00a0Misclassified employees (and independent contractors)\u00a0are considered\u00a0<a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/p1779.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">self-employed<\/a>\u00a0and ostensibly pay their own taxes. So misclassification has historically been a way for employers to not only evade employee tax obligations, but in some cases, commit other employer-related frauds. In 2013 the Texas Legislature\u00a0began its crackdown by passing a bill allowing\u00a0the TWC to fine a business $200 for each employee it deems misclassified.<\/p>\n<p>That measure, however, falls short \u2013 as it only applies to businesses with government contracts. An additional measure \u2013 House Bill <a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/84R\/billtext\/html\/HB00434I.htm\" target=\"_blank\" rel=\"noopener noreferrer\">434 <\/a>\u2013 looks to crack down on employers who misclassify.
