The below is the text of the <a href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/CP\/htm\/CP.41.htm\" target=\"_blank\" rel=\"noopener\">Texas statutes<\/a> related to exemplary, or punitive, damages that apply to civil cases involving serious injuries.<\/p>\n<p><strong>Sec. 41.001. DEFINITIONS.\u00a0<\/strong><\/p>\n<p>(5)\u00a0 &#8220;Exemplary damages&#8221; means any damages awarded as a penalty or by way of punishment but not for compensatory purposes. Exemplary damages are neither economic nor noneconomic damages. &#8216;Exemplary damages&#8217; includes punitive damages.<\/p>\n<p><strong>Sec. 41.003.\u00a0 STANDARDS FOR RECOVERY OF EXEMPLARY DAMAGES.\u00a0\u00a0<\/strong><\/p>\n<p>(a)\u00a0 Except as provided by Subsection (c), exemplary damages may be awarded only if the claimant proves by clear and convincing evidence that the harm with respect to which the claimant seeks recovery of exemplary damages results from:<\/p>\n<p style=\"padding-left: 80px;\">(1)\u00a0 fraud;<\/p>\n<p style=\"padding-left: 80px;\">(2)\u00a0 malice;\u00a0 or<\/p>\n<p style=\"padding-left: 80px;\">(3)\u00a0 gross negligence.<\/p>\n<p>(b)\u00a0 The claimant must prove by clear and convincing evidence the elements of exemplary damages as provided by this section.\u00a0 This burden of proof may not be shifted to the defendant or satisfied by evidence of ordinary negligence, bad faith, or a deceptive trade practice.<\/p>\n<p>(c)\u00a0 If the claimant relies on a statute establishing a cause of action and authorizing exemplary damages in specified circumstances or in conjunction with a specified culpable mental state, exemplary damages may be awarded only if the claimant proves by clear and convincing evidence that the damages result from the specified circumstances or culpable mental state.<\/p>\n<p>(d)\u00a0 Exemplary damages may be awarded only if the jury was unanimous in regard to finding liability for and the amount of exemplary damages.<\/p>\n<p>(e)\u00a0 In all cases where the issue of exemplary damages is submitted to the jury, the following instruction shall be included in the charge of the court:<\/p>\n<p>&#8220;You are instructed that, in order for you to find exemplary damages, your answer to the question regarding the amount of such damages must be unanimous.&#8221;<\/p>\n<p><b>Sec. 41.008.\u00a0 LIMITATION ON AMOUNT OF RECOVERY.\u00a0\u00a0<\/b><\/p>\n<p>(a)\u00a0 In an action in which a claimant seeks recovery of damages, the trier of fact shall determine the amount of economic damages separately from the amount of other compensatory damages.<\/p>\n<p>(b)\u00a0 Exemplary damages awarded against a defendant may not exceed an amount equal to the greater of:<\/p>\n<p style=\"padding-left: 80px;\">(1)(A) two times the amount of economic damages;\u00a0 plus<\/p>\n<p style=\"padding-left: 80px;\">(B)\u00a0 an amount equal to any noneconomic damages found by the jury, not to exceed $750,000;\u00a0 or<\/p>\n<p style=\"padding-left: 80px;\">(2)\u00a0 $200,000.<\/p>\n<h2 id=\"gethelp\">Get Help Seeking Exemplary Damages in Texas after Your Car Accident<\/h2>\n<h3>When the Standards of Proof Are Complex, You Need an Experienced Attorney<\/h3>\n<p>Filing a car accident lawsuit is often complicated.
